Im doing a research paper and I want to knowhow crime scene photos are obtained from the authorities.?

I want to know how people get the pictures to post on web sites. Most of the sites do not have contact links. My paper has to do with the moral issues of using real situations of death and violence of innocent people as entertainment. I want to know if crime scene photos are public record or what.

Reply:I'm sure many of them are older photos. Some may have been leaked from which ever police organization took them.





I found several articles online, mostly related to the Dale Earnhardt crash and subsequent autopsy photos. It seems that the law varies from state to state. Some states have said that if you are not related to the case in question (such as a family member or attorney), you need a judge's approval to obtain photos.





Before all of this, autopsy photos were considered public domain. I assume that you had to pay a fee for the photos like any other document. After the Earnhardt crash, his widow fought and won a case to prevent a newpaper organization from collecting the photos related to his death. Many states now treat autopsy photos as part of medical history and thus is protected as confidential information.





I don't know which states have enacted these types of laws and which have not. But I would certainly be upset if I found the autopsy photos of a loved one on a website.
